MassHealth Revises Eligibility Divisor to $274
Effective May 1, 2009, the penalty for transferring assets was revised to one day of ineligibility for every $274 transferred. The previous divisor was one day for every $267 transferred, so this results in a shorter penalty period during which MassHealth will not cover the costs of a skilled nursing facility.
The date MassHealth receives an application or eligibility review form determines which amount to use when calculating the penalty period. If received before May 1st: use $267, if received on or after May 1st: use $274. For example, for an application filed prior to May 1, a transfer of $100,000 would have caused 375 days, of ineligibility. The same transfer would cause 365 days of ineligibility for an application filed after May 1st.
